Terms and Conditions

1. Parties

Media Koerier, registered with the Dutch Chamber of Commerce under number 94186367, VAT identification number NL005070182B48, located at Generaal Spoorlaan 133, 2283 GE Rijswijk (hereinafter: “we” or “ZienKlaar”), provides access to the ZienKlaar platform (zienklaar.nl) to business users (hereinafter: “you” or “User”).

By using ZienKlaar you agree to these Terms and Conditions.

2. Services

ZienKlaar is a SaaS platform that enables virtual property staging for real estate professionals through image processing technology. Users upload photos of spaces and receive styled results generated by specialised AI models.

We grant a non-exclusive, non-transferable right to use the platform for the duration of the subscription or purchased credits.

3. Subscriptions and payment

Subscriptions are billed monthly. All prices shown on the website include 21% VAT; the amount displayed is the amount charged. For business purchases the amount excluding VAT is stated directly beneath it. Payment is processed via Mollie (iDEAL, SEPA or credit card).

In the event of late payment, we reserve the right to suspend access to the platform until payment is received.

Subscriptions can be cancelled monthly; cancellation takes effect at the end of the current billing period. You can cancel yourself under Subscription in the app.

Cooling-off period and refunds. If you buy as a consumer you have 14 days to change your mind, counted from the day after your purchase. At checkout you expressly ask us to start immediately and waive your right of withdrawal for the credits you use (article 6:230p of the Dutch Civil Code). For unused credits your cooling-off period applies in full: we refund those completely, including any that have since expired. Credits you have already used are set off against the refund. For a subscription we stop the monthly charge immediately. Send your request to info@zienklaar.nl; we refund via the same payment method.

4. Storage and use of images

Uploaded property photos and generated images are retained for 30 days in secure cloud storage. This allows you to retrieve and reprocess images via your gallery. After 30 days, files are automatically and permanently deleted.

Generated images are intended as impressions only. Users are solely responsible for correct labelling in property listings or other publications (“photo digitally styled for impression purposes”). Media Koerier is not liable for legal consequences resulting from improper use by the User.

Every image generated by ZienKlaar carries a visible, non-removable watermark indicating that it was edited with AI, in line with Article 50 of the EU AI Act (Regulation (EU) 2024/1689). This watermark may not be removed.

5. Intellectual property

The User retains ownership of uploaded photos. Generated images are offered under the terms of use of OpenAI and Google respectively; commercial use is permitted on paid plans in accordance with those providers' terms.

The ZienKlaar platform, software, brand name and visual identity are the property of Media Koerier.

6. Liability

Media Koerier is not liable for indirect damages, lost revenue or consequential damages resulting from the use or unavailability of the platform. Our total liability is limited to the amount paid by the User in the three months preceding the damaging event.

7. Changes

We may amend these terms at any time. The current version is always available at zienklaar.nl/algemene-voorwaarden, with the version number shown at the top of that page; please check it periodically. Continued use after the effective date constitutes acceptance.

8. Governing law

This agreement is governed by Dutch law. Disputes are submitted exclusively to the competent court in The Hague.
